ember runs three-minute prize rounds for fomo accounts. In short: taking part is free and automatic, a fomo account that holds $100 or more of $EMBER and posts a $EMBER thesis during the round is in the draw, every eligible entry has the same chance, the winner is selected by a draw you can verify, and the round's pot is paid to the payout address linked to the winning fomo account. By using the site you agree to these terms. If you do not agree, do not take part in a round.
Who we are and what these terms cover
“ember”, “we” and “us” refer to the operator of this site. These terms cover the website, the game, the published round records and the public API. fomo is a separate service with its own terms; we read public information from it but do not control it.
Eligibility
To take part in a round you must:
- be at least 18 years old, or the age of majority where you live if that is higher;
- live in a place where taking part in a prize draw of this kind is lawful for you;
- post a $EMBER thesis on fomo from an account that holds $EMBER worth $100 or more when the thesis is detected and again when entries close.
Eligibility is checked against the data available to us when a qualifying thesis is detected and again during the five-second lock at the end of the entry window. An entry that fails the check at close is removed from the round. You are responsible for making sure that taking part is lawful where you are.
Taking part in a round
Taking part is free and automatic: every fomo account that posts a $EMBER thesis while a round is open, and meets the eligibility rules, is entered into that round. There is no entry form. One card is allowed per fomo account per round. The optional Find my entry lookup on the game page checks the board in your browser and never submits anything.
A card belongs to the fomo account that posted the thesis; posting does not prove that you control that account beyond fomo's own posting rules, and we do not verify ownership separately. Payouts go to the payout address linked to the fomo account at the moment entries lock. Playing from an account you do not control will not redirect a payout to you.
You may not use automation to game entries, circumvent rate limits, or post theses from accounts you are not authorised to use.
Rounds, draws and results
A round lasts about three minutes: entries are open, the entry list locks for five seconds while eligibility is checked, the draw runs, and the result is published before the next round opens. Phase times come from our server.
Before a round opens, our server creates a secret seed and publishes its commitment. When entries lock, the eligible entry list is frozen and hashed. The draw combines the seed and that list with HMAC-SHA-256 to select one position, and the seed and entry list are revealed afterwards so anyone can check the result on the Check a result page. Every eligible entry has the same chance. The animation on the game board displays the result; it does not decide it.
A round is skipped when it has no eligible entries or the Prizepool is empty. A round is canceled when eligibility cannot be confirmed before the lock deadline, or when we cancel it to protect the game. Skipped and canceled rounds pay nothing, and their records appear under Winners.
Prizes and payouts
The pot shown while entries are open is the amount available in the Prizepool. When entries lock, that amount is reserved for the round and paid to the winning entry's payout address as recorded at lock. The Prizepool is funded by $EMBER trading fees claimed on a schedule, so pot sizes vary and are not guaranteed.
Payouts are processed automatically and are usually quick, but a payout can be delayed, retried or fail. The status of each payout is shown on the round record. We may correct a payout that was made in error, and we may withhold a payout while we investigate a suspected breach of these terms. You are responsible for any taxes on prizes you receive.
$EMBER is a third-party token. We do not sell it, and nothing on this site is investment, financial or tax advice. Holding any token carries risk, including the risk of losing its value.
Content you post
Your thesis is a public post on fomo. We display the text of the latest qualifying thesis with your entry on the board, in the feed and on the round record. Keep it lawful and respectful: we may hide or redact content that is abusive, unlawful, misleading or otherwise inappropriate, and we may remove an entry whose thesis is no longer available.
Fair use
You agree not to interfere with the service, probe or disrupt our systems, scrape the site in a way that degrades it for others, misrepresent your identity or your relationship to a fomo account, or use the game for money laundering or any other unlawful purpose. Published verification records and the public API may be used to check results and build honest tools.
Changes, pauses and cancellations
We may pause or resume the round in progress, cancel a round, change the round schedule, entry requirements or prize mechanics, and change or discontinue the game or any part of it at any time. Changes to entry requirements take effect for rounds that open after the change.
Disclaimers
The service is provided as is and as available. We rely on data from fomo and other third parties that may be delayed, incomplete or unavailable, and we do not promise that the service will be uninterrupted, error-free or available where you are. To the fullest extent permitted by law, we disclaim all warranties, express or implied.
Limitation of liability
To the fullest extent permitted by law, ember and the people who run it are not liable for indirect, incidental, special or consequential losses, lost profits, or loss of data or tokens arising from your use of the service. Our total liability for any claim relating to a round is limited to the pot of that round. Nothing in these terms limits liability that cannot be limited under applicable law.
Governing law and disputes
These terms are governed by the laws of the country where the operator is established, without regard to conflict-of-law rules. If a dispute arises, contact us first so we can try to resolve it informally.
Changes to these terms
We may update these terms. The effective date at the top shows the current version. If a change is material we will make it visible on the site before it takes effect. Continuing to use the site after a change means you accept the updated terms.
